Terms of Service

By creating an account or using themv.shop (a sub-brand of theMV), you agree to these terms. They are governed by South African law, including the Electronic Communications and Transactions Act (ECTA) and the Consumer Protection Act (CPA).
1. Accounts
- You must be at least 18 years old to create an account.
- You are responsible for keeping your login credentials secure and for all activity under your account.
- We may suspend or terminate accounts that violate these terms, the law, or that pose a risk to the platform or other users.
2. Themes & licensing
When you buy a theme from the marketplace, you receive a licence to use it — you do not buy the copyright. Each purchased theme is licensed:
- Non-exclusive — other buyers may use the same theme.
- Single-use — one theme per account/purchase.
- Perpetual — you may keep using a purchased theme indefinitely.
- Non-transferable — you may not resell or redistribute a theme.
3. Websites you build
- You are responsible for the content of websites you build, including any personal information you collect through forms.
- You must display a privacy policy on any site that collects personal data.
- If you use the newsletter or form blocks, you must obtain the visitor's consent before collecting their data.
- You must not build sites containing illegal, infringing, or prohibited content (see section 6).
4. Payments, fees & refunds
- All prices are displayed in South African Rand (ZAR).
- Payments are processed securely by Yoco. We never store your card details.
- Digital content: themes and digital downloads are delivered immediately. By completing the purchase you agree to receive the content immediately and acknowledge that the ECTA 7-business-day cooling-off period for digital content is waived.
- Physical goods: purchases from seller storefronts may qualify for returns in terms of the CPA and the seller's returns policy.
- Subscription fees are charged as disclosed at the time of purchase.
5. Designer terms
- Designers warrant that submitted themes are original works and do not infringe any third-party rights.
- Designer earnings are held as a balance and paid out on request, subject to the platform commission (20%) disclosed at submission.
- Themes are subject to automated security scanning and may be removed if found to contain malicious code.
6. Prohibited content
The following are not allowed on the platform:
- Illegal goods or services, adult content, or unlicensed gambling.
- Hate speech, harassment, or incitement to violence.
- Copyright- or trademark-infringing material.
- Malware, exploits, backdoors, phishing or fraud.
- Scam or deceptive operations.
We may remove prohibited content and terminate the responsible accounts.
7. Limitation of liability
We provide the platform on an "as is" basis and are not liable for indirect or consequential losses. Nothing in these terms limits liability for gross negligence, fraud, or any liability that cannot be excluded under South African law (CPA s.51). We are also not responsible for the content of sites built by users, subject to ECTA safe-harbour provisions and our takedown procedure.
8. Notice-and-takedown
If you believe content on the platform (including a theme or a user-built site) infringes your rights, send a notice to legal@themv.shop with: identification of the work, the URL of the infringing material, your contact details, and a statement of good faith. We acknowledge notices within 24 hours and act within 48 hours of a valid notice. Users whose content is removed may submit a counter-notice within 14 days.
9. Disputes & governing law
- These terms are governed by the laws of the Republic of South Africa.
- If you have a complaint, contact our support team first.
- Unresolved disputes may be referred to the relevant consumer body or the South African courts, which have jurisdiction.
10. Changes to these terms
We may update these terms from time to time. Material changes will be notified on the platform. Continued use of the platform after changes take effect means you accept the updated terms.
